    Dear folks

    General inquiry.

    Would you please be so kind and advise me where online (
    direct links please) I may find recorded in an unabridged text document the "Consideration of the merits" by the UNITED NATIONS Human Rights Committee in the matter of the "Communication" of the Former Irish Magdalene Laundries Inmates v. The Irish State, apparently decided by the UNHRC at some stage in the year 2010/2011.

    Any and all information that would help me to ascertain all details of this Irish case before the UNHRC would indeed be much appreciated.

    I myself (now in my late 60ies) am a like victim and many of my friends and acquaintances (all now in their late 40ies, 50ies, 60ies and 70ies) are, victims of similar state-sanctioned religious youth slave labour institutions existing en mass in the late 40ies, the 50ies, the 60ies and the 70ies in the Federal Republic of Germany (Bundesrepublik Deutschland / Westdeutschland), and we all are today left without any effective remedy and without appropriate compensation under existing German law for our pain, loss and historic as well as ongoing suffering in our old age; and nobody of all the parties involved and responsible for this state-sanctioned systemic abuse we have suffered has ever been taken or is being taken to task for all this.

Und einzig und allein DIES SIND DIE AUSSAGEN UND FESTSTELLUNGEN die den Opfern der Magdalenenheimen-Wäschereien in Irland zu einer wirklichen Entschädigung verholfen haben !!

Und nur so wird es auch in Deutschland und Österreich funktionieren - und auch in jedem anderen Vertragspartner-Land funktionieren !!

The NGO: German Institute for Human Rights (DIMR) in its formal submission to the Office of the High Commissioner for Human Rights - Convention against Torture, in Geneva in Switzerland, on 28.08.2013, made the following assertion, apparently speaking for the German Government and presenting its views; and apparenly its own views on the matter tally with those of the government:

    Please provide disaggregated data on the number of state-run and non-state closed and semi-closed institutions for children in Germany, how many children have been placed in these institutions during the last 10 years and children’s length of stay in these institutions. Please also provide data on the number of complaints received by authorities on cases of illtreatment, violence, abuse and negligence in the last ten years, and the outcomes of the complaints. Please provide information on the structure and practice of oversight over these institutions by public authorities and independent control mechanisms. Please also provide information on the allegations of ill-treatment in closed institutions for children run by the Haasenburg GmbH in the Federal state of Brandenburg, including steps taken by the public authorities in the wake of these allegations.

Das NGO: das Deutsche Institut für Menschenrechte (DIMR) berichtete dem Hohen Kommissar der Vereinten Nationen für Menschenrechte - Anti-Folter Komittee, in Genf in der Schweiz, am 28. August 2013, ganz offiziell, aber auf völlig verschleiernde Weise:

Das Deutsche Institut für Menschenrechte (DIMR) meint – was auch genau und genauso der Standpunkt der Regierung der Bundesrepublik Deutschland (BRD) ist – , dass mit dem Vollmerschen »Runden Tisch Heimerziehung« (2010-2011) und mit der Einrichtung in der BRD des darauffolgenden nicht-rechtsverbindlichen Rentenersatzfonds (2012) und mit der Einrichtung in der BRD des nicht-rechtsverbindlichen Sachleistungsfonds (2012) den westdeutschen ehemaligen Heimkindern, was die heutige Bundesrepublik Deutschland betrifft, Genüge getan sei und dass man dieses ganze Problem jetzt damit aus der Welt geschafft hätte und es somit endgültig zu den Akten legen könne.

Da unterliegt das Deutsche Institut für Menschenrechte (DIMR) aber einem gewaltigen Irrtum. - Die Aussage des Deutschen Instituts für Menschenrechte (DIMR) ist weit von der Wahrheit entfernt.

In all meinen Beiträgen ZU DIESEM THEMA (seit Di. 06.05.2014) geht es in jedem Fall darum den Staat, der selbst Nutznießer von Zwangsarbeit war und bewußt anderen Parteien, wie z.B., den Kirchen und dem Kapital, unter Anwendung von Folter und unmenschlichen und erniedrigenden Strafen und vielfachen anderen Misshandlungsmethoden angewandt gegen Kinder und Jugendliche in seiner Obhut und angeblich unter des Staates Schutz stehend, erlaubte diesen sich ebenso die Zwangsarbeit all dieser Schutzbefohlenen zum Nutzen zu machen, zur Verantwortung zu ziehen.

Zusammemfassung

Folgende Möglichkeiten und Alternativen bestehen und jeder Bürger in Europa / in der Europäischen Union kann diesen Weg gehen:

1.) Man kann sich gemäß Europarecht und Internationalem Menschenrecht an den EUROPÄISCHEN GERICHTSHOF FÜR MENSCHENRECHTE in Straßburg wenden, muß aber erst alle innerstaatlichen Gerichtsinstanzen in seinem eigenen Lande durchlaufen haben bevor diese Möglichkeit besteht.

( Jeder Bürger in welchem Land auch immer kann auch die folgenden beiden Wege gehen: )

2.) Man kann sich an das Office of the United Nations High Commissioner for Human Rights (OHCHR) / das Büro des Hohen Kommissars der Vereinten Nationen für Menschenrechte –
Anti-Folter Abteilung in Genf in der Schweiz wenden, muß aber erst alle innerstaatlichen Gerichtsinstanzen in seinem eigenen Lande durchlaufen haben bevor diese Möglichkeit besteht. Letzteres ist keine gerichtliche Prozedur sondern ein völkerechtlicher Weg.

3.) Man kann sich an seine eigene innerstaatliche Menschenrechtsorganisation wenden (falls solch eine Organisation im Lande existiert und diese auch wirklich unabhängig vom Staat ist), und diese innerstaatliche Meschenrechtsorganisation wird dann (a.) ihre eigene diesbezügliche Untersuchung gestalten/abhalten und (b.) wird es dann möglicherweise so so arrangieren (lobby), dass das UN ANTI-FOLTER KOMITTEE ebenso darauf aufmerksam wird und dem menschenrechtsverstoßenden Staat einen diesbezüglichen Fragenkatalogue vorlegt.

Es gibt keinen specifischen und einzigen DIREKTEN LINK auf den man verweisen könnte, der diese Wege und Möglichkeiten aufzeichnet, geschweige denn einen solchen Link der in Deutsch zu lesen wäre. Alles ist weitgehend in Englisch, denn dies ist die offizielle Sprache des Völkerrechts; auch für Deutschland und Österreich und für jedes andere beliebige Land der Welt ebenso.

Das folgende angeblich offizielle, aber undatierte und von niemandem unterschriebene [ „Standardauskunft“ ] Rundschreiben der Kölner Geschäftsstelle des Fonds Heimerziehung an Empfängerinnen und Empfänger von Mitteln aus den Fonds, worin von dem Erhalt eines nicht spezifizierten „Schreibens“ die Rede ist, nach Erhalt dessen angeblich Zahlungen an Empfängerinnen und Empfänger erfolgen werden, macht anscheinend seit dem 23.05.2014 in der Bundesrepublik Deutschland die Runden.

Bezüglich der Bundesrepublik Deutschland !

    Seriöse Schätzungen gehen aus von 800.000 bis 1.000.000 Heimkinder der Jahre 1949 - 1975 aus.

    Für unsere Berechnungen nehmen wir auch hier den unteren Wert von 800.000 Heimkindern und gehen davon aus, dass diese im Durchschnitt 1 Jahr gearbeitet haben.

    Weiter geht es mit den Berechnungen:

    800.000 Heimkinder x 10.000 DM Jahresnettolohn = 8.000.000.000 DM (in Worten: acht Milliarden DM)

    Da Kirchen, Institutionen, Staat und Industrie uns diese Löhne nie ausgezahlt haben, berechnen wir einen Zinssatz von 6% und eine mittlere Laufzeit von 50 Jahren und kommen so zu dem Betrag von


    147.361.234.199,93 DM oder – wieder großzügig gerechnet – 73.500.000.000 Euro.

    Das also ist die Summe, die uns geschuldet ist.

    Wenn wir diese Summe jetzt mal auf 800.000 ehemalige Heimkinder zurückrechnen, kann man leicht ersehen, dass jedem – JEDEM – Heimkind eine Summe von
    91.875 Euro mindestens zusteht!

    Das deckt noch keine Vergewaltigungen, keine zerbrochenen Biografien, keine lebenslangen Pein, keine erzwungene Frührente, keine verminderten Berufschancen ab. Es ist lediglich das Geld, was Kirchen, Staat und Industrie uns SCHULDEN!

    Zum Vergleich: in ihren Fonds eingezahlt haben sie 120.000.000 Euro. Sofort abgezogen haben sie 20.000.000 für die Anlauf- und Beratungsstellen, ergibt 100.000.000 Euro.

    Würden sich tatsächlich die 800.000 Ehemaligen melden, die Anrecht auf diesen Fonds haben, ergäbe dies einen Betrag von
    125,00 Euro pro Überlebenden ihrer Höllen.
